Article 126 explained in plain English
After Article 125 allows a challenge for forgery against any evidence, this article of the Implementing Regulations of the Criminal Procedure Law sets out the options available to the court and how they are documented:
- Staying the case: if the court decides to stay the case being heard before it based on Article 176 of the Law, it records that in the record and states the reason.
- Referring the papers for investigation: if the court decides to refer the papers challenged for forgery to the authority legally competent to investigate forgery, it sends them to it sealed.
- Not proceeding with verification: if the court sees no ground to proceed with verifying the forgery, or sees that deciding the case does not depend on the challenged paper, it states the reason in the case record. An objection to that is not made independently, but together with the objection to the judgment in the case.
- The court that hears the incidental forgery claim: it is the court hearing the case; if it lacks jurisdiction to hear forgery cases, it refers it to the competent court.
In practice, a person who challenges for forgery knows that the court's decision on his challenge will be reasoned and recorded, and that if he does not accept its decision not to proceed with verification, his route is to object to the final judgment in the case. It is followed by Article 127 on including in the case record the report on the judgment that an official paper is forged. To assess the usefulness of a challenge or objection in a particular case, you can consult a lawyer who specializes in criminal cases.
Practical example
At a hearing in a criminal court in Riyadh, Sarah challenged a report submitted against her as forged. The court saw that deciding the case did not depend on that report, so it stated the reason in the case record. If Sarah wants to object to that, her objection is made together with her objection to the judgment in the case.
