Article 113 explained in plain English
This article of the Regulations contains two provisions relating to the trial stage, both relying on reference to the Criminal Procedure Law:
- The irrelevant answer: when the court asks the accused about the charge against him under Article 160 of the Law, if he gives an irrelevant answer (one that does not connect with the question and does not respond to it), he is treated as one who refused to answer under Article 162 of the Law.
- Questioning witnesses: when the two parties question the witnesses under Article 162 of the Law, what Article 168 of the Law provides is observed.
The point of the first provision is that evading an answer with words unconnected to the question should not become a way to delay the trial; it takes the same treatment as refusing to answer.
This article does not state what follows from refusing to answer or what Article 168 of the Law provides, so refer to those articles directly to learn that.
If you have a pending case and need advice on your specific situation, it is best to consult a lawyer who specializes in criminal cases.
Practical example
A court in Dammam asked an accused about the charge against him, and he began speaking about matters unrelated to the question without answering it. The court considered his answer irrelevant, and treated him as one who refused to answer under Article 162 of the Law.
