Article 10 explained in plain English
This article sets the controls and conditions for temporary release referred to in Article (13) of the Law, which are three:
- No security concerns: no security concerns may result from the temporary release. Article 9 of the Regulations defined these concerns as fear of flight or disappearance, and harm to the interests of the investigations.
- A recognized reason: the release must be for recognized reasons, which are one of three types:
- Social reasons.
- Health reasons.
- Reasons connected with the evidence-gathering procedures required.
- Compliance with the measures: the released person must comply with the procedures and measures stated in the temporary release order.
The practical meaning is that temporary release is not an automatic right, but requires a recognized reason of the types mentioned, with no security concerns. After release the released person remains subject to obligations specified by the release order itself, and the article does not state their type.
The available text does not set out the content of Article 13 of the Law, and this article does not state the authority that issues the release order. A person seeking temporary release of a relative should consult a lawyer specialized in criminal cases.
Practical example
A detainee in a terrorism financing case has a mother who has fallen seriously ill. The social or health reason may be among the recognized reasons for temporary release, provided there are no security concerns, and if released he must comply with the measures in the release order.
