Article 92 explained in plain English
This Article is a referral rule that fills any gap in the obligations of the entities addressed by the Law.
What does it provide?
- That the provisions of the Anti-Money Laundering Law on the obligations of the following entities apply within the scope of this Law:
- Financial institutions.
- Designated non-financial businesses and professions.
- Non-profit organizations.
- That this applies where the Counter-Terrorism Crimes and Financing Law has no provision.
How is it understood? If a provision in this Law governs a particular obligation, it is the one applied. If there is no provision, reference is made to the provisions of the Anti-Money Laundering Law on the obligations of these entities.
The referral here is limited to the obligations of these entities; it is not a general referral to all the provisions of the Anti-Money Laundering Law.
It is followed by Article 93, which sets a similar referral rule but for procedures, providing for applying the Law of Criminal Procedure where this Law has no specific provision. It is preceded by Article 91 on establishing intent from the circumstances of the act.
To learn the obligations that apply to a particular entity under both laws together, one may consult a lawyer specializing in banking compliance and counter-terrorism financing.
