Article 6 explained in plain English
This article governs requests for records, documents and information in crimes under the Law, and has three paragraphs:
- Requests by the Public Prosecution: the Prosecution, on its own initiative or at the request of a criminal investigation officer, may ask any person, financial institutions, designated non-financial businesses and professions, or non-profit organizations to provide records, documents or information.
- Requests by the Presidency of State Security: the Presidency has the same power, but at the evidence-gathering stage.
- Confidentiality: anyone notified of the request may not disclose to any person its existence or anything about its execution, except to a person concerned in it, or to another employee or a member of management in order to obtain advice or determine the steps of execution.
In the first and second paragraphs, the person asked must carry out the request correctly and accurately as specified in it and urgently. If the request is addressed to a financial institution, it is carried out through the supervisory authority responsible for supervising it. The Regulations explain the mechanisms for carrying out these requests.
Financial institutions, designated non-financial businesses and professions, non-profit organizations and the supervisory authority mean what is stated in their definitions in Article 1. An institution or person who receives a request of this kind would do well to consult a lawyer specializing in criminal matters or in banking and finance.
Practical example
A bank in Riyadh receives, through the competent supervisory authority, a request from the Public Prosecution for a customer's account statements. The bank must carry out the request accurately and urgently, and the compliance officer may not tell the customer about the request, but may consult his or her manager to determine the steps of execution.
