Article 86 explained in plain English
This Article deals with the exchange of information inside the Kingdom between the competent authorities, and balances the needs of investigation against the right to confidentiality.
What may be exchanged? The information disclosed by:
- Financial institutions.
- Designated non-financial businesses and professions.
- Non-profit organizations.
Between whom? Between the competent authorities in the Kingdom.
Controls:
- Full commitment to the confidentiality of that information.
- Not disclosing it except to the extent necessary for its use in investigations or cases relating to any of the crimes provided for in the Law.
Exchange is therefore permitted, but disclosure beyond what is necessary is not, and the use of the information is limited to investigations and cases relating to the crimes of this Law.
The Article comes after Article 85 on looking after victims and protecting witnesses, and before Article 87, which requires everyone concerned with applying the Law to keep confidential what they learn and not to disclose without need the procedures of reporting, evidence-gathering, investigation and trial.
Anyone who believes his information was disclosed outside this scope may consult a lawyer specializing in criminal cases.
