Article 79 explained in plain English
This Article explains what happens after the General Directorate of Financial Intelligence analyzes the information it holds, and contains two provisions:
First: Referral
- The Directorate may refer information and the results of its analysis to the competent authority.
- Referral takes place on its own initiative or on request.
- Its condition is that the Directorate assesses that there are grounds for suspicion that a transaction is linked to the crime of terrorism financing.
Second: Freedom of action and independence
The Directorate has the power to carry out its functions freely, including making an independent decision on:
- analyzing particular information.
- requesting it.
- redirecting it.
- referring it.
Referral is therefore not automatic for every report; it rests on the Directorate's assessment that grounds for suspicion exist.
It is preceded by Article 78, which imposes confidentiality on the Directorate's employees, and followed by Article 80, which allows the Directorate to exchange the information it holds with the competent authority.
Anyone who learns of a referral concerning him would do best to consult a lawyer specializing in criminal cases.
