Article 72 explained in plain English
This article opens the door to international cooperation in investigating the crimes set out in the Law, and gives the competent authorities the following powers:
- Exchanging available information with counterpart authorities in other states.
- Carrying out investigations on their behalf.
- Forming joint investigation teams to provide assistance in investigations or for the purpose of the controlled delivery of funds.
The basis on which cooperation rests:
- The existence of agreements in force between the Kingdom and the other state, or
- reciprocity.
Controls:
- It must be done in accordance with the legal procedures followed.
- It must not constitute a breach of the provisions and customs on confidentiality of information.
- In accordance with what the Implementing Regulations set.
This reflects the fact that terrorism and terrorist financing crimes often cross borders. It is followed by Article 73, which regulates receiving and extraditing accused and convicted persons.
The article does not name the competent authorities or detail the procedures; these are left to the legal procedures and the Regulations. The article also permits these forms of cooperation rather than requiring them; it is a power exercised by the competent authorities when needed.
