Article 36 explained in plain English
This article deals with the training that precedes terrorist crimes or paves the way for them, and punishes it with imprisonment for no less than 10 years and no more than 20 years, provided the act is to commit any of the crimes set out in the Law.
There are two kinds of punishable acts:
- Designating a place for training, preparing it for that, or managing it.
- Training, being trained or financing training in any of the following:
- Using weapons, explosives, nuclear, chemical, biological or radiological materials, poisons, incendiary devices, or wired, wireless or electronic means of communication, or manufacturing, preparing, assembling, developing, equipping, possessing, holding or bringing them in.
- Forgery, counterfeiting, or using media means or methods.
- Military or security arts, or combat skills.
Note that the article punishes the trainer, the trainee and the person who finances training with the same penalty. Training in these fields falls under the article only if it is to commit a crime under the Law.
The article follows Article 35, which punishes inciting joining a terrorist entity and recruiting for it with imprisonment of 8 to 25 years, and precedes Article 37, which punishes supplying a terrorist entity with weapons, explosives or documents with imprisonment of 10 to 30 years.
To assess any accusation under this article, it is advisable to consult a lawyer who specializes in criminal cases.
Practical example
A person rented a rest house in a remote area and equipped it so that members of a group could train in it on using explosives in preparation for carrying out an attack. If this is established, whoever designated and prepared the place, and whoever trained or was trained in it, is punished with imprisonment of 10 to 20 years.
