Article 35 explained in plain English
This article explains who imposes the penalties and how, and has five paragraphs:
- Table of violations: the Council, which under Article 1 is the Authority's Board of Directors, issues a table classifying violations and the penalties set for each.
- Administrative violations: the Authority considers them and imposes the penalties provided in Article 34, other than imprisonment, according to controls and procedures the Council sets. The Authority can therefore impose the fine of up to SAR 5 million, closure of the factory or warehouse until the violation is corrected, and license revocation.
- Violations that constitute crimes under Article 31: the Authority refers them to the Bureau of Investigation and Public Prosecution to investigate and prosecute them and take the legal steps to refer them to the competent court. Article 31 lists acts such as fraud in the product, circulating counterfeit, spoiled or expired products, counterfeiting packaging with intent to commit fraud, and obstructing inspectors.
- Temporary closure: during the investigation or trial the Authority may close the factory or warehouse temporarily for a set period or until the period for correcting the violation ends.
- Publication: the Authority may publish the penalty decision at the violator's expense.
The Authority does not impose imprisonment; it is imposed through referral to the investigating body and then the competent court. The article does not specify which violations are administrative and which constitute crimes; the table issued by the Council classifies the violations. Article 36 follows, regulating grievances against penalty decisions. Anyone against whom a decision has been issued or who has been referred for investigation can consult a lawyer specializing in criminal cases and food and drug regulations.
Practical example
The Authority found at a factory in Riyadh counterfeit packaging made with intent to commit fraud, so it referred the violation to the investigating and prosecuting body and closed the factory temporarily during the investigation. After the penalty was issued, it published its decision at the factory's expense.
