Article 34 explained in plain English
This article specifies the penalties imposed on anyone who violates any provision of the Law or its Implementing Regulations. One or more of the following may be imposed:
- A fine of up to SAR 5,000,000.
- Closure of the factory or warehouse until the violation is corrected.
- Revocation of the license of the factory or warehouse.
- Imprisonment for up to five years.
The fine and imprisonment figures are upper limits; the text sets no minimum. The penalty may be doubled where the violation is repeated, and this is optional, not mandatory.
The article opens with the phrase "without prejudice to any more severe penalty provided for in another law", meaning that if the same act is punishable by a more severe penalty under another law, this article does not prevent that more severe penalty from being applied.
Article 35 follows, allocating responsibility: the Authority's Board of Directors issues a table classifying violations and their penalties, the Authority considers administrative violations and imposes penalties other than imprisonment, and refers violations that constitute crimes to the Bureau of Investigation and Public Prosecution. It was preceded by Article 33, which makes the violator bear the costs of destruction. Anyone accused of a violation can consult a lawyer specializing in criminal cases and food and drug regulations.
Practical example
The owner of a warehouse in Dammam was found to have stored and sold unlisted cosmetic products. He may be punished with a fine of up to SAR 5 million and closure of the warehouse until the violation is corrected, and the two penalties may be combined. If he repeats the violation later, the penalty may be doubled.
