Article 26 explained in plain English
This article sets out who carries out a withdrawal or recall decision and who bears its cost:
- The lister's obligation: if the Authority decides to withdraw or recall the cosmetic product, the lister, meaning the person in whose name the product is registered with the Authority under Article 1, must carry it out.
- The deadline: it must be carried out within the period the Authority sets; the text does not state a fixed period.
- If the lister fails to act: if it does not withdraw or recall within that period, the Authority must withdraw the product and destroy it, as applicable, at the lister's expense.
- Procedures: set by the Implementing Regulations.
The phrase "at its expense" means the lister bears the costs if the Authority has to act itself. The phrase "as applicable" means the Authority withdraws the product, destroys it, or does both, depending on the case.
This article relates to Article 25, which allows the Authority to suspend circulation of a product when it suspects a violation, and to Article 27, which prohibits circulation of any cosmetic product the Authority has announced to be delisted, banned, withdrawn, recalled or suspended. Anyone who has received a withdrawal or recall decision and wants to understand their position can consult a lawyer specializing in commercial law and food and drug regulations.
Practical example
The Authority decided to recall a batch of hair dye listed in the name of a company in Jeddah and set a period for carrying out the recall. The company was late and did not act within the period, so the Authority withdrew the batch from the shops and destroyed it, and the company bore the costs.
