Article 24 explained in plain English
This article sets out what the Authority does once a product is established to be dangerous or non-compliant. It applies in three cases, and any one of them is enough:
- The product is established to be unsafe.
- The product is established to be harmful to health.
- The product is established to be not listed with the Authority.
In these cases the Authority must take one or more of the following measures:
- Delisting it from the register of cosmetic products.
- Banning its circulation.
- Withdrawing or recalling it; under Article 1, withdrawal is a measure the Authority carries out to remove the product from the markets, while recall is a measure taken by the lister, on its own initiative or at the Authority's request, to retrieve the unsafe or non-compliant product and prevent its circulation.
- Suspending its circulation for a period the Authority sets.
The Authority chooses the appropriate measure or measures, but it is bound to take at least one of them whenever one of the cases is established. This differs from Article 23, which requires a warning when the Authority considers that the product affects public health, and from Article 25, which allows circulation to be suspended on mere suspicion of a violation. Anyone whose product is subject to one of these measures can consult a lawyer specializing in commercial law and food and drug regulations.
Practical example
After analyzing samples, the Authority established that an imported nail polish remover is harmful to health. It decided to delist it and withdraw it from the markets together, which the article allows by providing for one or more measures.
