Article 43 explained in plain English
This article sets out the relationship of the current Law to the earlier enactments, providing that it replaces two of them:
- The Cooperative Societies Law issued by Decree No. 26 dated 25/6/1382 AH.
- The Regulation on Subsidies to Cooperative Societies issued by Council of Ministers Resolution No. 419 dated 10/5/1398 AH.
"Replaces" means that these two enactments are no longer the reference for regulating cooperative societies and their subsidies, and that this Law is what applies in their place. One should therefore not rely on the provisions of the earlier Law or the earlier subsidies regulation as being in force.
This provision differs from the general formula that repeals only "what conflicts"; it expressly names the two enactments it replaces, and by its wording replaces them completely.
This provision is linked to Article 44, which provides that the Law is published in the Official Gazette and takes effect 90 days after the date of its publication, so the Law's replacing the earlier enactments is tied to its taking effect.
It is also linked to Article 42, which lets the Minister issue the Regulations and the decisions needed to implement the Law, with the Regulations to be issued within a maximum of 90 days of its issuance and to apply from the date the Law takes effect.
Anyone in a situation that arose under the earlier Law, such as a society registered under it, who wants to know how this replacement affects him may consult a lawyer specializing in commercial and corporate cases.
