Article 325 explained in plain English
This article sets the period within which claims arising from a marine insurance contract are heard: two years, and its start differs according to the type of claim:
- Claiming the premium: from the date it falls due.
- Compensation for damage to the ship: from the date the accident occurred.
- Compensation for damage to goods: from the date the ship arrived or the date on which it should have arrived; if the accident came after either of them, from the date of the accident.
- Settling damage by abandonment: from the date of the accident; if the contract sets a period for bringing the abandonment claim, from the date it expires.
- Contribution to general average or salvage expenses: from the date the insured paid.
- The insured's claim against the insurer because of recourse by a third party: from the date the third party brought the claim against him or from the date he paid.
Recovering sums paid under the contract: the claim is not heard after two years from the date of payment of what was not due.
Interruption of the period: in all cases it is interrupted by a demand by registered letter, by delivery of the documents relating to the claim, or by appointing an expert to assess the damage, in addition to the grounds provided by law.
Article 324 provides that the insurer is subrogated to the insured in his rights within the limit of what he paid. To calculate the period in a particular case, it is advisable to consult a lawyer who specializes in insurance and maritime cases.
Practical example
A ship arrives at the port of Jeddah, and an insured shipment belonging to a company in Riyadh is found damaged on 1 Ramadan. The two-year period for the compensation claim starts from the date the ship arrived, and if the company sends its demand by registered letter within the period, the running of the period is interrupted.
