المضمن يمكنه إذا شاء أن يبين في ورقة قضية التبليغ التي سبق ذكرها في المادة (367) المحررة آنفا بأنه يريد إجراء قضية الترك حالا ويطلب من صاحب السكورتة أن يعطيه التضمينات المشروط إعطاؤها في ظرف المدة المعينة بعقد المقاولة ( الكوندراتو ) أو أنه يريد إجراء الترك بظرف المدات المقررة نظاما.
