إذا لم تجر أحكام هاتين المادتين السالفتين يسقط حينئذ عقد مقاولة الاستقراض البحري من حيثيته ويعد من قبيل الاستقراض المعتاد وبناء على ذلك كما أن الشخص المقرض يضيع امتيازه في حق الأشياء التي أقرض من أجلها وكذلك المستقرض يكون مجبورا شخصا ومالا بأن يعطيه دراهمه وربحها النظامي أيضا.
