Article 39 explained in plain English
This article sets three important rules for the work of associations and organizations:
1- Collecting donations:
- Public benefit associations may collect donations.
- Other associations may collect donations with the Ministry's approval, and only to carry out specific programs.
- In all cases they must comply with the laws, instructions and controls issued by the competent bodies in this regard; being allowed to collect does not mean being exempt from them.
2- Dealing with international bodies: associations and organizations may not contract or agree with states, international organizations or institutions except with the approval of the Ministry and the competent authority, which under Article 1 is the body designated by the Council of Ministers. Both approvals are required together.
3- Adherence to objectives and public order: an association or organization may not depart from the objectives set for it, nor may its activities and work involve anything that leads to disturbing public order or stirring up discord and division among citizens.
These rules cover associations and organizations together in paragraphs 2 and 3, while paragraph 1 concerns associations. The article itself sets no penalty for violation; reference is made to the other provisions of the Law.
If you have a specific case concerning an organization or association, it is best to consult a lawyer who specializes in non-profit sector and civil society association law.
Practical example
A cultural civil society association in Abha is not a public benefit association and wants to collect donations to hold a program teaching Arabic calligraphy. It must first obtain the Ministry's approval to collect donations for this specific program, while complying with the controls issued by the competent bodies. If an international organization offers to fund the program under an agreement, it may not sign it except with the approval of the Ministry and the competent authority.
