Article 12 explained in plain English
This Article regulates the review of disability pensions to confirm that their cause continues.
Who is covered: any person who has not completed fifty years of age and receives a pension because of inability to work, whether under this Law or any earlier retirement law.
The procedure: The Agency may at any time refer him to doctors it appoints to examine him at his place of residence or any other place specified for him.
If he refuses the examination:
- If he refuses despite being notified by registered letter that he must be examined, payment of his pension is suspended until he presents himself for examination.
- If he does not present himself within one month of the date payment was suspended, he is notified a second time in the same way.
- If his refusal continues for one year from the date of the second notice, his case is resettled on the basis of what he would have been entitled to had he left service by release.
If the examination shows he has recovered: his case is likewise resettled on the basis of what he would have been entitled to had he left service by release.
If the person refusing is a beneficiary in respect of the pensioner (that is, one of his relatives for whom a pension was determined, as defined in Article 1), his entitlement is cut off permanently.
The preceding Article 11 sets out transitional provisions for existing pensions, whereas this Article concerns the disability pension specifically. If your pension has been suspended or resettled under it, it is best to consult a lawyer who specializes in retirement and administrative matters.
Practical example
Saad is 42 years old and receives a pension because of his inability to work. A registered letter reached him from the Agency asking him to attend a medical examination, but he did not attend, so payment of his pension was suspended. After a month without his presenting himself, he was notified a second time, and if his refusal continues for a year from the second notice, his case is resettled as if he had left service by release.
