Article 91 explained in plain English
This article, in the sixth part on licenses and flight training, sets a general condition for everyone serving on an aircraft's flight crew, meaning pilots and other members of the flying crew.
Its scope: any aircraft operating in the Kingdom's territory, whether registered in the Kingdom or abroad.
The condition: the flight crew member must hold a license that is:
- valid;
- issued by the State of registry (that is, the State in which the aircraft is registered according to the definitions) and by the authority that registers the nationality mark, as the text states;
- taking into account the standards set out in international treaties.
Practical effect: A pilot flying an aircraft registered in a foreign State within the Kingdom's airspace needs a valid license issued by that State under international standards. For those serving on an aircraft registered in the Kingdom, Article 92 sets a special rule, requiring a valid license entitling them to perform their duties, issued or validated by the Authority.
This article follows Article 90 on prohibited areas. Anyone with a question about the validity of their license to work in the Kingdom should consult the Authority or a lawyer specializing in civil aviation law.
Practical example
A foreign company operates charter flights to Jeddah with an aircraft registered in its home country. Every member of its flight crew must hold a valid license issued by the aircraft's State of registry that takes account of the standards of international treaties.
