Article 66 explained in plain English
This article deals with a special case: an aircraft on which one of the rights listed in Article 56 has been created to secure a debt (such as a mortgage) causes damage on the surface within the Kingdom's territory, and the forced sale takes place in the Kingdom. When that aircraft, or another aircraft of the same owner burdened with similar rights in favor of the same creditor, is seized, the following applies to protect the injured party:
- (a): The provisions of paragraph (3) of Article 63 have no effect with respect to the injured party or their successor if they are among the seizing creditors. That paragraph prevents a forced sale unless the rights ranking ahead of the seizing creditor's right are paid or assumed by the buyer.
- (b): The rights that give security burdening the seized aircraft, referred to in the text as those in Article 54, may not be asserted against the injured parties or their successors except up to 80% of the sale price.
Exception: This protection does not apply if the operator insured the surface damage appropriately and sufficiently, or insured it in their name with a State or an insurance institution in one of the countries. If the laws applied in the Kingdom, where the aircraft is sold, contain no other restriction, the damage is considered insured if the insured amount is commensurate with the value of the seized aircraft when new.
The purpose is that the injured party on the ground keeps a share of the aircraft's price despite the mortgages on it, unless insurance covers their damage. Anyone injured by an aircraft may consult a lawyer specializing in compensation and civil aviation matters.
Practical example
A part falls from a cargo aircraft mortgaged to a bank onto a warehouse in Dammam and destroys it, and the operator did not have sufficient insurance for surface damage. The warehouse owner seizes the aircraft and it is sold by forced sale; the bank's mortgage can be asserted against the owner only up to 80% of the sale price, so part of the price remains for the owner to recover their compensation.
