Article 164 explained in plain English
This article gives the Authority a practical tool for dealing with violations, in addition to penalties.
The power: The Authority may take the measures needed to:
- prevent the violation before it occurs;
- stop it if it is ongoing; and
- remove it once it has occurred.
Its scope: Violations of the provisions of Chapter Two of Part Three of this Law. The text of that chapter is not set out here, so its subject cannot be determined from this article alone.
Costs: The violator must pay all the costs the authorities incur in preventing, stopping or removing the violation. So the public body does not bear the cost of dealing with a violation committed by someone else.
Without prejudice to imposing the prescribed penalties: That is, these measures do not replace penalties; the violator may be punished and also required to bear the costs of removal.
Practical effect: A person who commits a violation within this article's scope may face two things: removal of the violation at his own expense, and the penalty prescribed for it.
This article follows Article 163, which sets out the administrative sanctions the Authority may take, such as suspending licenses, barring an aircraft from flying and closing unlicensed offices, and precedes Article 165, which punishes operating without a license, permit or authorization. Anyone required to pay the costs of removing a violation may consult a lawyer specializing in administrative cases.
