Article 134 explained in plain English
This article defines the legal nature of the relationship between the air carrier and those it deals with, and the sources of the rules that govern it.
The parties: the air carrier on one side, and the passenger, or the shipper of goods and the consignee, on the other.
Nature of the liability: contractual liability under the contract of air carriage concluded with each of them. A ticket or air waybill is a contract, and the consequences of breaching it are viewed within the framework of the contract.
Governing rules:
- the international treaties the Kingdom has joined;
- the provisions of this Law;
- other laws; and
- applicable instructions.
The article does not specify the amount or the cases of compensation; it refers to these sources.
Practical effect: A passenger harmed by the carrier, or a shipper whose goods are damaged, bases the claim on the contract of carriage and on the treaties and laws mentioned.
This article is linked to Article 133, which defines the air carrier as the contracting or actual carrier as the case may be, and defines the Montreal Convention. It is followed by Article 135, which applies the international treaties the Kingdom has joined to international and domestic air carriage. Anyone with a claim against an air carrier may consult a lawyer specializing in compensation and aviation cases.
Practical example
