Article 133 explained in plain English
This article defines two key terms that recur in the chapter on air carrier liability, unless the context requires otherwise.
1- Air carrier: The contracting carrier or the actual carrier, as the case may be, in accordance with the contract of air carriage and the 1961 Guadalajara Convention.
- Contracting carrier: the party that concluded the contract of carriage with the passenger or shipper.
- Actual carrier: the party that actually performs the carriage, which may be a different company from the one that sold the ticket.
This matters because the term air carrier in this chapter may apply to either of them depending on the case, and is not limited to the company from which the passenger bought the ticket.
2- Montreal Convention: The Convention for the Unification of Certain Rules for International Carriage by Air, done at Montreal on 28/5/1999.
The article is definitional and does not itself create rights, but it fixes what the two terms mean wherever they appear. It is followed by Article 134, which makes the air carrier's liability toward the passenger, shipper and consignee contractual liability, subject to the international treaties the Kingdom has joined, the provisions of the Law, and other applicable laws and instructions. Anyone facing a dispute with an air carrier may consult a lawyer specializing in aviation and compensation cases.
