Article 112 explained in plain English
This article regulates the participation of States and other bodies in the technical investigation of aviation accidents, and distinguishes two cases.
First case: a Saudi aircraft, or a foreign aircraft operated by a Saudi, that has an accident in the Kingdom's territory, over the high seas, or over land not owned by any State:
- the Center may ask the States and bodies the Regulations specify to appoint accredited representatives;
- to take part in the technical investigation as observers.
Second case: a foreign aircraft operated by a foreigner that has an accident in the Kingdom's territory:
- each of the States and bodies the Regulations specify has the right to appoint an accredited representative to take part in the investigation;
- the representative may be assisted by one or more advisers.
The difference is clear in the wording: in the first case participation is at the Center's request and as an observer, while in the second it is a right of the States and bodies concerned.
Rights of the representatives: The Regulations set the rights of the representatives of the States and bodies taking part in the investigation, and the text does not give their details.
The words "the Center" replaced "the Bureau" in paragraph (1) under Council of Ministers Decision No. (158) dated 20/2/1445 AH. This article follows Article 111, under which the board of directors decides whether to conduct an investigation, and precedes Article 113, which requires the security authorities and administrative bodies to facilitate the work of investigation committees. Anyone with an interest in an international investigation may consult a lawyer specializing in international matters and civil aviation law.
