Article 62 explained in plain English
This article gives the Minister a tool of direct oversight over the chambers of commerce and the Federation of Chambers, by appointing a representative to them.
- When: in cases the Minister sees fit, so the appointment is optional and left to his or her discretion, and is not always made for every chamber.
- Where: at the chamber or at the Federation of Chambers.
- The representative's task: following the implementation of laws and decisions.
- Powers: attending the meetings of the General Assembly, the board of directors and the committees, and seeing the minutes, books and accounts.
- Limits: no right to vote in these meetings.
So the representative monitors, follows up and sees, but does not take part in making decisions with his or her vote, and decisions remain with the members of the competent bodies.
The article comes after Article 61 on subjecting the staff of the chambers and the Federation to the Labor Law and the Social Insurance Law, and is followed by Article 63, which gives the Minister or his or her delegate supervision of the application of the Law's provisions. Appointing a representative is one form of this general supervision.
The article does not specify the cases in which a representative is appointed, the length of the appointment, or the procedures for it.
Practical example
The Minister sees a need to follow up the implementation of decisions at a chamber of commerce and appoints a representative to it. The representative attends the board meeting and sees the minutes and accounts, but does not vote on decisions, because the article does not give the representative a right to vote.
