Article 15 explained in plain English
This article sets out the penalties imposed on anyone who violates the provisions of the Law, decided by the committees formed under Article 14.
The four penalties:
- A warning.
- A financial fine not exceeding SAR 100,000.
- Temporary suspension of the license.
- Cancellation of the license.
The violator may be punished with one or more of these penalties, so a fine may be combined with a suspension, for example. The article does not specify the period of temporary suspension nor grade the penalty by type of violation; the appropriate penalty is decided through the committee.
The right to file a grievance: a person against whom a decision imposing a penalty other than a warning is issued may file a grievance before the Board of Grievances. As for a warning alone, the article does not mention that a grievance against it is permitted. The article does not mention a period for the grievance.
The phrase "anyone who violates" is general, so it covers violating any provision of the Law, such as failing to insure (Article 5) or failing to notify (Article 6). Anyone against whom a penalty is issued would be well advised to consult a lawyer specializing in administrative cases before the Board of Grievances.
Practical example
A company in Dammam used an unlicensed vehicle to transport cash, and the committee decided to fine it SAR 50,000 and temporarily suspend its license. The company may file a grievance against this decision before the Board of Grievances because it is a penalty other than a warning.
