Article 14 explained in plain English
This article establishes the body competent to consider violations of the Law.
- Who forms it: the Minister of Interior.
- Its number and location: one or more committees in the regions.
- Its composition: three members, one of whom at least holds a sharia or legal qualification.
- Its competence: considering violations of this Law, and deciding the appropriate penalty.
The committee cannot impose any penalty it sees fit; it decides the penalty in accordance with Article 15, which sets the penalties as a warning, a financial fine not exceeding SAR 100,000, temporary suspension of the license, and cancellation of the license, and more than one penalty may be combined. The presence of a member with a sharia or legal qualification ensures that the legal side is taken into account when deciding the violation and the penalty. Article 15 also allows a person against whom a decision imposing a penalty other than a warning is issued to file a grievance before the Board of Grievances.
Anyone whose violation is referred to this committee would be well advised to consult a lawyer specializing in administrative cases to prepare his defense, and to consider a grievance if a penalty is imposed.
Practical example
A cash transport company in Makkah did not notify Public Security of the transport of a large sum. The violation is presented to the committee formed in the region, which decides the appropriate penalty from among the penalties in Article 15.
