Article 22 explained in plain English
This Article protects the buyer directly: it does not stop at punishing the offender but requires him to repair what his act caused. Its provisions:
- Withdrawing the adulterated product: the offender must withdraw the adulterated product.
- Refund of value: he must return the product's value to the buyer.
- Conditions and procedures: the Implementing Regulations set them; the Article does not state the method or time limit for withdrawal or how the value is refunded.
- Compensation is a separate right: the phrase "without prejudice to the right of anyone who suffered harm to compensation" means that a refund of the price does not end the injured person's rights; anyone harmed by one of the violations keeps the right to claim compensation.
So if a person buys an adulterated product, he can at least recover its value. If the product caused him further harm, such as damage to property or to health, he may also claim compensation for it.
This Article comes after Article 21, under which proof that a product was adulterated leads to its destruction or disposal and the confiscation of the tools of the fraud, and before Article 23, which allows a travel ban to be requested against anyone the investigation shows committed a violation.
Anyone who wants to claim compensation for harm caused by an adulterated product would do well to consult a lawyer who specializes in civil cases and compensation.
Practical example
Noura bought a handbag from an online store as an original for SAR 3,000, and it was proven to be a counterfeit. The offending store must withdraw the product and refund its value to her as the Implementing Regulations provide, and she may in addition claim compensation if she suffered other harm.
