Article 5 explained in plain English
This article identifies the authority responsible for field oversight of facilities:
Paragraph 1: The Ministry or a service provider, as the case may be, handles:
- Supervision, oversight and inspection of agricultural and veterinary facilities. Under Article 1, agricultural facilities include farms, nurseries, apiaries, shops, warehouses, slaughterhouses and the like, and veterinary facilities include a hospital, clinic, pharmacy, laboratory and the like.
- Obtaining documents and samples.
The purpose is specific: to ensure that the provisions of the Law and the Implementing Regulations are applied.
Paragraph 2: The Ministry may, where needed, coordinate with the competent authorities to take the necessary measures that enable these tasks to be carried out.
Note that the Law allows these tasks to be assigned to a "service provider", which under Article 1 includes companies, establishments and others. A facility may therefore be visited by an inspector from the Ministry or from a service provider.
In practice, facility owners should expect oversight visits and be ready to provide documents and samples. The article does not set the inspection procedures or timings in detail. It is followed by Article 6, which regulates pesticides and veterinary preparations.
