Article 6 explained in plain English
Article 6 regulates who leases advertising board sites, and begins with an exception: it does not apply to what is stated in paragraphs (2, 3, 11) of Article 1. Among these exceptions, according to Article 1, are the signage boards of commercial shops (paragraph 2) and advertising boards located on private property such as land, house roofs and buildings (paragraph 3).
The leasing bodies are:
- The Ministry of Municipal and Rural Affairs: for all board sites in paragraphs (1, 4) of Article 1, that is, boards on sidewalks, lighting poles, squares and street intersections inside cities and boards on buses inside cities, as well as board sites on the roads built and maintained by the Ministry of Communications inside the built-up area.
- The Roads General Authority: for board sites on the roads it builds and maintains outside the built-up area.
- The General Presidency of Youth Welfare: for the sites in paragraph (6) and the advertisements in paragraph (7).
- The General Ports Organization: for the sites in paragraph (8).
- The General Presidency of Civil Aviation: for the sites in paragraph (9).
- The General Railways Organization: for the sites in paragraph (10).
This article comes after Article 5, which sets the bases for leasing, including the precise specification of sites and board areas, that boards must not affect traffic and pedestrian movement, their removal when the contract ends unless the lessor requests otherwise, and leasing to companies and establishments licensed to carry on the advertising activity.
The article was amended by Council of Ministers Resolution No. (590) dated 12/9/1441 AH, then the "Roads General Authority" replaced the "Ministry of Transport and Logistic Services" by Resolution No. (586) dated 22/8/1444 AH. A person who wishes to enter a tender for advertising sites may consult a lawyer specializing in commercial matters and government contracts.
Practical example
A licensed advertising company wishes to lease board sites on lighting poles in the streets of Riyadh. These sites are of the type in paragraph (1) of Article 1, so the leasing body is the Ministry of Municipal and Rural Affairs.
