Article 9 explained in plain English
This article shows the Authority's sources of funding and how its funds are managed.
First: resources:
- An amount not exceeding 10% of the tax and customs revenue income of the previous financial year, excluding the taxes collected from gas, oil and hydrocarbon materials.
- The fees it receives for its services.
- Gifts, donations, grants, bequests and endowments the Board accepts under the provisions governing them.
- Returns on investing its available financial resources and assets.
- Any other resource the Board approves, so long as it does not conflict with the laws and instructions.
The 10% is a ceiling, not a fixed amount, and the article does not specify which body decides the actual amount within that ceiling. The basis is also the revenue of the previous year, not the current year, with taxes on gas, oil and hydrocarbon materials excluded from the calculation.
Second: revenues and accounts:
- All the Authority's revenues are deposited in the Ministry of Finance's current account at the Saudi Central Bank.
- The Authority opens an account for itself at the Saudi Central Bank, and may open accounts in banks licensed to operate in the Kingdom.
- Spending from these accounts is under the Authority's budget and financial regulations.
This article is linked to Article 10, which gives the Authority an independent annual budget from its resources and a general reserve equal to twice its total expenditure shown in its previous annual budget, deposited in its account after all revenues are paid to the Ministry of Finance's current account.
