Article 20 explained in plain English
This article protects a protected person from having their protection ended without cause. It provides that protection may not be ended while its grounds still exist, unless one of the following cases applies:
- The protected person gives the program administration something in writing showing that they do not wish protection to continue.
- They do not comply with the protection instructions communicated to them, despite being warned by any means of notification recognized under the Law.
- They deliberately give the program administration incorrect information.
- They refuse to cooperate with the program administration, or with the law-enforcement body, the evidence-gathering body, the investigating body or the court.
Note that the second case requires a warning, and the third requires intent.
Ending when the grounds cease: protection also ends if the reasons for which it was imposed no longer exist.
The article refers to the Regulations the setting of the rules and procedures for ending protection under paragraphs (1) and (2).
Article 21 complements this provision. It requires that the decision to end protection be written and reasoned by the program administration, and that the protected person be notified of it at least 15 days before it takes effect, and allows the body that submitted the protection request or the protected person to file a complaint against it directly with the Attorney General within 10 days of learning of the decision. Anyone facing a decision to end their protection can consult a lawyer who specializes in criminal cases.
Practical example
Nasser was a protected person in Abha but did not comply with the protection instructions communicated to him. His protection may not be ended for this reason while its grounds still exist, unless he has been warned by a means of notification recognized under the Law and continues not to comply.
