Article 67 explained in plain English
This article is the list of violations in the Water Law, and it begins with the phrase "without prejudice to other laws"; that is, treating an act as a violation here does not prevent other laws from applying to it.
The seventeen acts can be divided into groups:
- Licensing and approvals: carrying out an activity subject to the Law without a license (1), and the licensee's failure to obtain the necessary approvals under the Law, the regulations, the license conditions or the exemptions (6).
- Information: giving the Ministry or the Authority false or misleading information (2), the licensee's failure to provide the information and data required (3), and withholding information necessary for activities of using or developing sources or providing the service (4).
- Performance of the activity and instructions: the licensee's failure to provide what it was licensed to provide (5), failure to comply with the decisions and instructions of the Ministry or the Authority (7), and failure to comply with specifications and standards relating to public health, the environment, safety or security (13).
- Water and its facilities: misusing a water source or using it for other than its designated purpose (8), carrying out an activity that leads to water scarcity or pollution (11), harming water infrastructure or desalination, purification or treatment plants or their protected zones, or a licensee's equipment or devices, or misusing them (12), and connecting to the water or sewage network in an unlawful way (14).
- Conduct in the market and in emergencies: exploiting emergencies or disasters affecting water sources (9), and undermining or limiting fair competition (10).
- Oversight and assistance: preventing or obstructing monitors and those responsible for inspection, detection and investigation from doing their work (15), and helping others commit any violation (16).
Item 17 is a general item that makes breaching any provision of the Law or its regulations or of the conditions of licenses or exemptions a violation.
Penalties are regulated by Article 68, including suspending the activity for a period not exceeding one year, canceling the license or exemption, and a fine of up to twenty million riyals for each violation. Article 66 shows who detects these violations. Anyone alleged to have committed a violation would do well to consult a lawyer specializing in water and environmental regulation and administrative cases.
Practical example
The owner of a rest house in Al-Ahsa connected his building to the sewage network in an unlawful way, without going through the required procedures. This act is expressly mentioned in item 14 of this article as a violation of the Law, which exposes him to the penalties set out in Article 68.
