Article 11 explained in plain English
This article sets out the procedures for considering travel document violations, in four paragraphs:
- The committee: the Minister of Interior forms by decision one or more committees, each of three members including a legal adviser, competent to consider the violations provided for in Article 10 and to propose suitable penalties for them.
- Imposing the penalty and the grievance: imposing the penalty is by a decision of the Minister of Interior or his delegate. The person against whom the decision is issued has the right to file a grievance before the Board of Grievances in accordance with its law.
- Referral to the Public Prosecution: violations that call for a more severe penalty under other laws, or that are connected with security aspects, are referred to the Public Prosecution after the competent authority in the Ministry of Interior completes the legal procedures. This paragraph, in its current text, was amended by Royal Decree No. (M/11) dated 18/1/1443 AH.
- Automatic cancellation of the document: committing one of the violations in paragraphs 1 to 5 of Article 10 results in automatic cancellation of the travel document concerned, that is, by force of law.
The five paragraphs in Article 10 are: changing the information in a passport or laissez-passer by an incompetent party, deliberate destruction, alteration or change of the photograph, negligence leading to loss, deliberately enabling another person to use the document or selling or pledging it, and using another person's document or attempting or assisting in that.
Note that the committee proposes the penalty, and the decision is issued by the Minister or his delegate. Under Article 10 bis, the Regulations classify the violations and their penalties. Anyone against whom a decision is issued can consult a lawyer who specializes in administrative cases (the Board of Grievances).
Practical example
It was established that a person deliberately let his friend use his passport. The committee considered the violation and proposed a penalty, a decision was issued on it by the Minister of Interior or his delegate, and the passport concerned was automatically cancelled. The person has the right to file a grievance against the decision before the Board of Grievances.
