Article 16 explained in plain English
This is the main penalties article of the Tourism Law. It applies without prejudice to any more severe penalty in another law, and without affecting the injured party's right to compensation.
Penalties: one or more of: a warning, closing the tourism facility or part of it temporarily or permanently, a downgrade in classification, suspension of the license for no more than one year, revocation of the license, and a fine of no more than SAR 1,000,000.
Powers of the committee (the committee in paragraph 1 of Article 15):
- A fine for each day the violator continues after being notified of its decision, from the date the decision specifies.
- Doubling the penalty for a repeat violation without exceeding its maximum; a violation is a repeat if it occurs within one year of the previous one.
- Publishing the operative part of the decision at the violator's expense according to the type, seriousness and impact of the violation, after it becomes final through the passage of time or a final judgment.
Obligations: the decision requires the violator to remove the violation, restore what was harmed, pay compensation, return amounts to their owners if any, and pay the amounts and gains to the state's general treasury.
Assessment and schedule: the penalty is set according to the nature of each violation, its seriousness and the aggravating and mitigating circumstances, and the Minister issues a graduated schedule of violations and their penalties, which includes violations whose fine does not exceed SAR 10,000 and which the inspector issues immediately.
Appeal: decisions of the Ministry may be appealed before the Administrative Court within 60 days of notification. It is advisable to consult a lawyer who specializes in administrative cases before the period expires.
Practical example
The committee decided to suspend the license of a tourism office in Riyadh for six months and fine it for collecting money from customers without providing the service, and required it to return the money to its owners.
