Article 6 explained in plain English
This article protects the buyer's right to back out, by preventing the seller from requiring any advance payment from him before the end of the period during which he may withdraw from or cancel the contract under paragraph (1) of Article 5.
The periods meant in paragraph (1) of Article 5 are:
- Withdrawal without cause within 10 days of the date both parties sign the contract or any binding preliminary document, and if the tenth day is an official holiday, it extends to the first working day after it.
- Cancellation within 3 months of signing if the contract does not include the information specified in paragraph (1) of Article 3, and if the information is provided within the three months, the withdrawal period (10 days) starts from the date it is provided.
- Withdrawal without cause within the 10 days following the passing of the three months if that information was not provided within them.
So the buyer is not obliged to pay anything in advance as long as the period applicable to his case has not yet ended. The reason is that his decision to withdraw should be free, without fear of losing a sum he has paid.
This is complemented by paragraph (3) of Article 5, which provides that the buyer does not bear any of the seller's costs and expenses relating to the contract if he withdraws from or cancels it under paragraph (1), and Article 7, which treats the withdrawal or cancellation as cancellation of the credit agreement if the value of the contract is covered by credit.
Practical example
Noura in Jeddah signed a timesharing contract at a resort, and the seller asked her to pay 20% of the value on the same day. The seller may not require this payment before the end of the withdrawal period, which is 10 days from signing if the contract includes the required information.
