Article 10 explained in plain English
This article regulates the body that decides violations of the Law and the route for objecting to its decisions.
First - the violations committee (paragraph 1):
- One or more committees are formed by decision of the chairman of the Authority's board.
- It has no fewer than three members, one of whom is a legal adviser.
- It is competent to hear violations of the Law's provisions and impose the penalties it provides for.
- Its decisions are approved by the Authority's secretary general.
- The Implementing Regulations set how the committee works and its members' remuneration.
This is without prejudice to the injured person's right to claim compensation for the harm he suffered as a result of the violation of the Law's provisions. Imposing the penalty on the violator does not remove the injured person's right to compensation.
Second - grievance (paragraph 2): the committee's decisions may be the subject of a grievance before the Board of Grievances within 60 days of the date of notification of the decision.
Violations reach the committee through the employees referred to in Article 9, who follow the performance of licensees, detect violations and refer them to it. The penalties the committee imposes are set by Article 11, including fines of up to SAR 500,000 and suspension or cancellation of the license in specific cases. Anyone against whom a committee decision has been issued may consult a lawyer specialized in administrative matters, bearing in mind the sixty-day period.
Practical example
The committee issued a decision fining a company in Riyadh for violating the Law's provisions, and it was notified of it at the beginning of the month. The company has the right to file a grievance against the decision before the Board of Grievances within 60 days of the date it was notified, and any buyer harmed by the violation keeps the right to claim compensation.
