Article 14 explained in plain English
This article is the formula for calculating the social security pension. The pension for an independent person or a family equals:
Calculated minimum for the pension − calculated income
To determine the calculated minimum, the article sets two rules:
- For the independent person and the breadwinner: the calculated minimum for the pension equals the basic minimum for calculating the pension. Then an increase for each additional dependent of the breadwinner is calculated, provided that this increase does not exceed the basic minimum.
- The mechanism and percentages: the mechanism and percentage of calculated income, and the calculated minimum for the pension, are set in proportion to the resources available to social security, as the Regulations specify.
To clarify from the definitions in Article 1: "calculated income" is a part of monthly income set for the purpose of calculating the pension, so not all income is necessarily subtracted. The "basic minimum" is a value covering the basic needs of each independent person or breadwinner without increases or deductions, while the "calculated minimum" includes increases and deductions.
The article does not state specific figures. The value of the basic minimum is set by a decision of the Council of Ministers under Article 15, and the percentage and mechanism of calculated income are set by the Regulations. The amount of a particular person's pension therefore cannot be known from the text alone.
The article is linked to Article 13, which allows the family to choose a qualified replacement breadwinner when the breadwinner's lack of capacity or incapacity due to illness is established.
Practical example
A family in Jazan consists of a breadwinner and three dependents. Its calculated minimum for the pension is worked out starting with the basic minimum for the breadwinner, then an increase is added for each additional dependent that does not exceed the basic minimum. The family's calculated income is then subtracted, and the result is its monthly pension. The actual figures are set by the Regulations and the Council of Ministers' decision.
