Article 6 explained in plain English
This article balances security surveillance with people's privacy through three rules:
First: places where installing cameras is prohibited for the categories covered by the Law:
- Medical examination, in-patient, physiotherapy and changing rooms, bathrooms, women's salons and clubs, and the residential unit in a tourist accommodation facility.
- Rooms where medical operations are performed and private places; the regulations specify the categories covered by this item.
- Any other places the regulations specify under the Law's provisions.
Second: notice signs: a visible sign or signs must be placed in the places covered by the Law showing that they are equipped with security surveillance cameras, and the regulations set their specifications, number and places.
Third: a ban on transferring or publishing recordings except in one of the following cases:
- The approval of the Ministry or the Presidency of State Security, as the case may be.
- A judicial order.
- A request from the competent investigation body.
So the owner of a facility or its employees may not publish a clip from the surveillance cameras on social media or pass it to others outside these cases.
The article is connected to Article 5, which requires the Ministry's approval for carrying on the activities of installing and operating cameras, and to Article 7, which gives the Ministry or the Presidency of State Security the power to watch the feed and recordings, keep a copy of them and provide them to the competent court and the competent investigation body if requested.
If a recording concerning you has been published or a violation has occurred in this regard, you may consult a lawyer specialized in administrative matters or cybercrimes.
Practical example
A shop's camera in Riyadh recorded a quarrel between two customers, and one of the employees wanted to publish the clip on his account. This article prohibits transferring or publishing recordings except with the approval of the Ministry or the Presidency of State Security, or by a judicial order, or at the request of the competent investigation body, so he may not publish it on his own.
