Article 9 explained in plain English
This article has two parts: rights for persons with disabilities, and obligations on health bodies.
First: the rights. Persons with disabilities have the right to health services, including:
- Preventive and therapeutic services, medical rehabilitation, general health care, home care and other services, according to the medical requirements of each disability.
- Examination and diagnostic services, health registration and medical reports.
- Reproductive health services, programs for early detection of disability, and ensuring the availability of programs that prevent the worsening of a diagnosed disability.
Second: the obligations. The bodies that provide health services must:
- Include the requirements of persons with disabilities in health services and programs, in drug and nutrition information, and in health policies, strategies and plans.
- Remove any discriminatory conditions that prevent them from obtaining the full right to medical and rehabilitative care and assistive devices from medical insurance companies.
The Regulations set the mechanism for implementing these provisions. In practice, disability must not be a reason for discriminatory conditions in medical insurance that deprive the person of care or assistive devices. "Discrimination" here is understood under the definition in Article 1, which covers what has the effect of impairing rights. This article comes after Article 8 on education and before Article 10 on work and employment.
Anyone who has faced a refusal or a discriminatory condition in a health or insurance service can consult a lawyer specializing in the rights of persons with disabilities or in administrative cases.
Practical example
A mother of a child with a mobility disability needs a medical report and a rehabilitation program to prevent her child's condition from worsening. Article 9 establishes the child's right to diagnosis, medical reports and medical rehabilitation, and requires the relevant health bodies to remove any discriminatory condition that prevents the child from the full right to care with the insurance company, according to the mechanism set by the Regulations.
