Article 10 explained in plain English
This article provides that the Law guarantees the right of persons with disabilities to work and employment without discrimination, and sets three matters to be taken into account to achieve this:
- Employment and training programs: designing and implementing programs to employ persons with disabilities and train them vocationally and technically, so as to encourage government and private employers to attract and employ them.
- Adapting work: adapting work systems and environments to the requirements of persons with disabilities.
- Equal opportunity: providing equal opportunities for their employment.
The Regulations set the mechanism for implementing these provisions. The article does not mention employment quotas or detailed obligations on a particular body.
"Discrimination" is understood here under the definition in Article 1, which covers any discrimination, exclusion or restriction because of disability whose purpose or effect is to impair rights. A condition or procedure that appears neutral may amount to discrimination if its effect is to impair the rights of persons with disabilities or exclude them because of disability. The principle of adaptation is also linked to the idea of "reasonable accommodation" in Article 1, which means measures to meet special requirements without imposing a disproportionate burden on the body.
This article comes after Article 9 on health services and before Article 11 on the facilities of the Two Holy Mosques and mosques. Anyone who believes they were excluded from a job because of a disability can consult a lawyer specializing in the rights of persons with disabilities or in administrative cases.
Practical example
Ahmed is an accounting graduate with a mobility disability who applied for a job at a company in Jeddah. Article 10 guarantees him the right to employment without discrimination and equal opportunity, and provides for adapting work environments to the requirements of persons with disabilities, according to the mechanism set by the Regulations.
