Article 34 explained in plain English
This article gives anyone against whom the violations committee has issued a decision the right to challenge it in court, and sets this out in three elements:
- What the grievance is against: the decision of the committee provided for in Article 33, which is the committee formed by a decision of the head of the Authority, of at least three members including a Sharia or legal adviser, that considers violations and imposes the penalties set out in Article 32 according to the type of violation, its seriousness and its impact, and whose decision is approved by the head of the Authority or whoever the head delegates.
- The competent body: the Administrative Court.
- The period: within 60 days of the date of notification of the decision.
The most important practical point is when the period starts running: it starts from the date of notification of the decision, not from the date it was issued. Anyone notified of a decision should therefore record the date of their notification and act before the period expires.
The grievance here is permissive, through the word "may"; it is a right of the person concerned, not an obligation on them. The article does not set out the procedures for filing the grievance or its effect on enforcement of the decision, so nothing should be assumed on that from its text.
Article 35 then provides for a penalty of imprisonment for up to 3 years for violating the provisions of Articles 4, 21, 27 and 30, with referral to the Public Prosecution and prosecution before the competent court, which is a different path from the committee's decisions.
Anyone against whom the committee has issued a decision would do best to consult a lawyer specializing in administrative cases as soon as they are notified.
Practical example
A licensed company in Riyadh was notified of the committee's decision imposing a fine on it, and the company considered the decision wrong. It filed a grievance before the Administrative Court 40 days after the date it was notified of the decision, which is within the 60-day period.
