Article 2 explained in plain English
This article sets out the purpose of the Law in three objectives:
- Regulating real estate investment scheme activity, that is, setting a clear framework for offering real estate projects in which a number of persons participate, managing them and ending them.
- Raising the level of transparency and disclosure, so that the participant knows what is happening in the scheme in which they have put their money.
- Protecting the rights of all parties to the real estate investment scheme; the protection is not limited to participants but covers all parties to the scheme.
This article does not itself create a specific obligation or penalty, but it helps in understanding and interpreting the other provisions; where the meaning of a provision of the Law is in doubt, these objectives are looked to for guidance. It is complemented by Article 3, which makes the General Authority for Real Estate the body that regulates this activity under the Law and the regulations, including issuing the license and overseeing and supervising schemes.
It is understood from the definitions in Article 1 that these objectives concern real estate investment schemes in the sense of the Law, that is, joint real estate development projects, not real estate investment funds. Anyone with a dispute or inquiry about a particular scheme is best advised to consult a lawyer specialized in real estate matters.
Practical example
Ahmed joined a real estate investment scheme to develop residential land in Qassim, and wanted to understand why the licensee is bound by so many regulatory procedures. When he read Article 2 he learned that the Law aims to regulate this activity, raise transparency and disclosure and protect the rights of the parties to the scheme, including participants like him.
