Article 7 explained in plain English
This article places restrictions on the outside activities of a member of the Authority to protect the independence and prestige of the work, and contains two provisions:
- Ban on combining roles: a member may not combine his post with:
- engaging in trade; or
- any profession or work inconsistent with the independence and dignity of the work of the Authority.
- Power to bar: the Authority's management committee may decide to bar a member from undertaking any work that it considers conflicts with the duties of the post and its proper performance.
The article uses the words "the Authority" and "members of the Authority" as worded, and what is meant by them in this Law is the members of the Public Prosecution.
The first provision is fixed by the text of the Law: trade is prohibited in all cases, as is any profession or work inconsistent with the independence and dignity of the work. The second provision gives the committee discretion to bar other work if it considers that it conflicts with the duties of the post or its proper performance, even if it is not trade.
This article complements Article 6, which binds the members to the duties of the Civil Service Law, and is followed by Article 8, which bars them from disclosing secrets they learn through their work even after leaving service.
Anyone who needs to assess whether a particular activity falls within this ban should consult a lawyer specialized in administrative cases.
Practical example
A Public Prosecution member in Jeddah inherited a share in a shop and wanted to manage it himself. This article bars him from combining his post with engaging in trade. If he wanted some other work that is not trade, the Authority's management committee may bar him from it if it considers that it conflicts with the duties of his post and its proper performance.
