Article 8 explained in plain English
Article 8 sets the penalty for violating the Regulations and the route of challenging it:
1) The fine:
- A financial fine is imposed on anyone who violates any provision of the Regulations.
- Its maximum is five thousand riyals.
- Its amount is set according to the violations classification table provided for in Article 9, which the Ministry of Interior prepares jointly with the Saudi Commission for Tourism and National Heritage and the relevant bodies, and which is issued by decision of the Minister of Interior.
2) Doubling: the amount of the fine is doubled if the same violation is repeated within one year of the date it was first committed. Doubling is conditional on the violation being the same one and on the repetition occurring within a year. The text is worded "is doubled", not "may be doubled".
3) Grievance: a person against whom a fine decision has been issued may file a grievance against it before the competent administrative court.
Paragraph (1) was amended to its current text by Council of Ministers Resolution No. (95) dated 2/2/1441 AH.
This article follows Article 7, which gives the Minister of Interior the power to determine the administrative enforcement bodies and the mechanisms for imposing penalties. Anyone fined who wishes to file a grievance before the administrative court can consult a specialized lawyer in administrative cases (the Board of Grievances).
Practical example
Khalid is fined for a public decency violation in a market in Riyadh. Six months later he commits the same violation again, so the fine is doubled because the repetition occurred within a year of the first time. He has the right to file a grievance against the fine decision before the competent administrative court.
