Article 9 explained in plain English
This article sets the basic obligations of three categories of economic operators: the manufacturer, the authorized representative and the importer, whenever any of them is responsible for placing the product on the markets. There are four obligations:
- Ensuring that the product is safe or presumed to be safe.
- Ensuring its full conformity with the provisions of the technical regulations and requirements applicable to it, including the essential requirements.
- Assessing the potential risks sufficiently to enable themselves to take appropriate corrective actions; the assessment procedures are set according to the guidance documents issued by the Authority.
- Providing proof that the product is safe when the competent bodies request it, including, where appropriate, its conformity with the technical regulations or standards, and the corrective actions taken.
The article refers to the regulations the setting of the responsibilities and duties of each of the three according to their provision.
The fourth obligation means in practice that these operators must keep what proves the safety of their products, since they are required to provide it on request. Under Article 1, the authorized representative is a natural person, or a legal person established in the Kingdom, mandated by a manufacturer outside the Kingdom to act on its behalf.
It is preceded by Article 8 and followed by Article 10, which requires the three to provide the consumer with all information about the hazard associated with the product that is not clear to the consumer. A importer or manufacturer who needs to organize their obligations would do well to consult a lawyer who specializes in commercial cases.
Practical example
A company in Riyadh imports household electrical appliances. Before putting them on sale it must ensure they are safe and conform to the technical regulations, assess their risks, and keep what proves this so as to provide it if the competent bodies request it.
