Article 30 explained in plain English
This article regulates the destruction of products that violate the Law.
- Who orders it: the Authority, in coordination with the competent authorities. The wording is permissive ("may").
- The condition: that it follows a final judgment of the competent court confiscating the product subject of the violation. There is no destruction before a final confiscation judgment.
- Who carries it out: one or more committees formed for this purpose.
- The costs: borne by the violator.
- The details: the regulations set how the committee is formed and how it works.
The article lays out a logical sequence: a violation, then a final court judgment of confiscation, and only then may the Authority order destruction. This order protects the product owner's right, since their product is not destroyed until the court has given its final word on confiscation.
It is preceded by Article 29, which requires the inspector to keep confidentiality. It is followed by Article 31, which provides that the manufacturer is responsible for any damage resulting from a defect in the product it placed on the market, and leaves it to the regulations to define the defect giving rise to liability.
A person against whom a confiscation judgment or destruction order has been issued is advised to consult a lawyer who specializes in administrative and commercial matters.
Practical example
A final judgment of the competent court confiscated a shipment of unsafe electrical cables belonging to a merchant in Dammam. The Authority, in coordination with the competent authorities, may order their destruction through a committee formed for that purpose, and the merchant bears the cost of destruction.
