Article 3 explained in plain English
This article sets the basic condition for granting a licence to any private laboratory, which is that the applicant for the licence commit to providing two things:
- Human staff: the scientifically qualified specialists needed for the work.
- Equipment: the equipment and devices needed for work at the laboratory.
No fixed size of staff or devices is required, but it must be consistent with the volume and nature of the work, as determined by the competent authority and the Center. The competent authority under Article 1 is one of the ministries or authorities mentioned there depending on the context, and the Center is the Saudi Accreditation Center.
This article was amended by Royal Decree No. M/31 dated 6/4/1443 AH, and the text presented is the text in force.
This article complements Article 2, which allows using qualified and licensed private national laboratories, and Article 4, under which the Implementing Regulations determine the categories of laboratories and the conditions required for each category on the recommendation of the Center. A person wishing to license a laboratory needs to refer to what the competent authority, the Center and the Regulations determine, and can consult a lawyer specializing in commercial and company matters.
Practical example
A businessman in Dammam wants to open a laboratory to test building materials. Before he is granted the licence he must commit to providing scientifically qualified engineers and technicians and testing equipment suitable for the volume of work he plans, as determined by the competent authority and the Saudi Accreditation Center.
