Article 9 explained in plain English
This article sets out an obligation and a list of prohibitions.
The obligation: every person responsible for a printed material must adhere to objective, constructive criticism that aims at the public interest and is based on correct facts and evidence.
The prohibitions: it is prohibited to publish by any means any of the following:
- What violates the provisions of Islamic Sharia or the laws in force.
- What calls for disrupting the security or public order of the country, or serves foreign interests that conflict with the national interest.
- Attacking or harming the reputation or dignity of, or disparaging or personally insulting, the Grand Mufti of the Kingdom, members of the Council of Senior Scholars, state officials or any of its employees, or any private natural or legal person.
- Stirring up discord and sowing division among citizens.
- Encouraging or inciting crime.
- What harms the public interest of the country.
- The facts of investigations or trials without obtaining permission from the authority legally empowered to give it.
Note that the phrase "by any means" means the prohibition is not limited to printed paper publications. Item 3 also protects private individuals and entities, not only public figures. And item 7 does not ban publishing the facts of investigations and trials outright; it requires permission from the legally empowered authority.
This article spells out the limit set by Article 8, which guaranteed freedom of expression within the bounds of Sharia and statutory provisions. The article was amended by Royal Decree No. M/20 dated 11/4/1433 AH, and the text shown is the text in force. This article does not state the penalty; anyone facing a complaint or accountability because of something they published should consult a lawyer who specializes in media and publishing law.
Practical example
A blogger published personal accusations against the owner of a company in Riyadh without correct facts or evidence. This falls under the prohibition in item 3, because it harms the reputation of a private natural or legal person, which is prohibited by any means of publication.
